Consent, Waiver, and Release regarding my image and any submissions
Submissions
In connection with the 50th anniversary of BYU Women’s Conference, I may directly or indirectly provide BYU (defined below) with creative materials (e.g., photographs, videos, audio recordings, writings, artwork, or other materials) for use related to BYU Women’s Conference (collectively and individually, “Submissions”). By providing Submissions, I give to Brigham Young University and its affiliates (including but not limited to The Church of Jesus Christ of Latter-day Saints, Philanthropies, and other Church-owned institutions), agents, assigns, employees, and licensees (together, “BYU”) a non-exclusive, irrevocable, worldwide, and perpetual license to reproduce, distribute, create derivative works of, perform, display, transmit, and otherwise use such Submissions in all formats and manners, provided the uses are related to BYU Women’s Conference. I represent that I have all the rights needed to grant this license.
Image
I give to BYU the rights to display, exhibit, transmit, reproduce, store, record, publish, republish, photograph, digitize, modify, alter, edit, adapt, create derivative works, and otherwise use my name, image, likeness, appearance, voice, biographical information, signature, interview(s), quote(s), written statement(s), audio recording(s), visual recording(s), audiovisual recording(s), and personal photograph(s), (collectively and individually, my “Image”).
Materials
I agree that all materials created by or on behalf of BYU that incorporate any of my Image and/or the Submission (together, “Materials”), in any medium or format, including but not limited to in/on magazines, brochures, and other print publications, via internet or digital transmissions or delivery methods, for any purpose, including but not limited to advertising, marketing, public relations, publicity, and promotion of BYU. BYU is and will be the exclusive owner of all rights, including copyright, in the Materials. I convey to BYU my entire right, title, and interest, if any, and all copyrights and other intellectual property rights in the Materials, and the right to sue to enforce such rights. BYU has no obligation to create or use the Materials or to exercise any rights given by this Consent and Release (“Agreement”). I understand that I will receive no compensation in connection with this Agreement.
Waiver and Release
To the fullest extent permitted by applicable law, I irrevocably waive all legal and equitable rights relating to all liabilities, claims, demands, actions, suits, damages, and expenses, including but not limited to claims for copyright or trademark infringement, infringement of moral rights, libel, defamation, invasion of any rights of privacy
(including intrusion, false light, public disclosure of private facts, and misappropriation of name or likeness), violation of rights of publicity, physical or emotional injury or distress, or any similar claim or cause of action in tort, contract, or any other legal theory, now known or hereafter known in any jurisdiction throughout the world (“Claims”), arising directly or indirectly from BYU’s exercise of its rights under this Agreement or the production, advertising, promotion, or other use of the Materials, whether resulting in whole or in part from the negligence of BYU or any other person, and I agree not to make or bring any such Claim against BYU and forever release and discharge BYU from liability under such Claims.
By submitting or participating in any BYU Women’s Conference related recording, interview, photo, story, or other Submission, I represent that:
- I have read and understand this Agreement and agree to all its terms.
- I agree that this Agreement supersedes all prior or contemporaneous agreements or other discussions related to my Image, any Submission, and/or the Materials.
- I have the full right to enter into this Agreement granting the rights herein and that this grant does not violate any rights of any third party.
- I agree to hold BYU harmless from any claim made by any third party arising out of BYU’s use of my Image, any Submission, and/or the Materials.
By submitting this form I (and my parent/guardian if I am a minor) give BYU permission to process, transfer, and use my personal information in accordance with the BYU Privacy Notice. I (and my parent/guardian if I am a minor) understand my information may be transferred, processed, and stored via third-party servers, and could potentially be viewed by others.
